Bankruptcy Exemptions

Are you worried that if you file, you will lose everything?  Each state’s bankruptcy code has “exemptions” which allow you to keep items.  So long as these exemptions are applied properly, you will be able to keep your home, car, furniture, retirement, and other items.  Ohio and Kentucky have different sets of exemptions available.

In Ohio, your bankruptcy exemptions may include the following:

  • Homestead up to $161,375
  • Personal vehicle up to a value of $4,450
  • Household goods up to a total value of $14,875

  • Tools and equipment for a professional trade
  • Payments because of a personal injury claim up to $24,700
  • 401k, 403(b), IRA, and other tax-exempt retirement accounts
  • IRA and ROTH IRA accounts up to $1,283,025
  • Pension
  • Wages and public assistance
  • A burial plot

Kentucky’s exemptions change often, but the exemptions include:

  • Homestead of $5,000
  • Personal vehicle up to a value of $2,500
  • A burial plot of $5,000 (in lieu of homestead)
  • Household goods up to a total value of $3,000
  • Health aides
  • Tools and equipment for a professional trade
  • Payments because of a personal injury claim up to $7,500
  • Retirement Accounts
  • Pension
  • Wages and public assistance
